Client details

1. The website

The Designer will deliver a one-page, mobile-friendly website for the Client's business, including contact information, services, hours, and location, published online at a web address the Client can share. Extra pages, online ordering, booking systems, logins, or other new features are not included and will be quoted separately in writing.

2. Preview and changes before payment

The Designer builds the site first and shows the Client a preview. Before paying, the Client may request up to 2 rounds of changes. A "round" is one list of requested edits given at the same time. Additional rounds before launch are quoted separately. The Client owes nothing if they decide not to go ahead before paying, and the preview will be taken offline on request.

3. Price and payment

One-time website fee: as quoted by the Designer

The website fee is due in full before the site goes live (launch). Payment may be made by card (secure payment link), cash, or check.

4. All sales are final: no refunds

Because the Client reviews and approves the finished website before paying, all payments are final and non-refundable once the site is launched. Care plan payments are non-refundable for any month already started; canceling stops future payments.

5. Optional monthly care plan

Without the care plan, the Client may still request changes after launch; each request will be quoted before any work is done.

6. Hosting: where the website is kept

The Designer is not responsible for outages, changes, or fees caused by third-party services (hosting, domain registrars, payment processors, or map providers).

7. Domain name (web address)

Domain promises:

8. Ownership

Once the website fee is paid in full, the Client owns the website's written content and design as delivered, and may move it elsewhere. The Client's own logos, photos, and text always remain the Client's. The Designer keeps ownership of the Designer's general tools, templates, and code used to make many sites, and grants the Client a permanent, free license to use them as part of the Client's website.

9. Portfolio and advertising permission (optional)

If this box is not checked, the Designer will not feature the Client's website in portfolios, social media, or advertising. The site may include a small "Website by Busterrdust" credit in its footer, which the Client may have removed at any time at no cost.

10. Testimonial permission (optional)

11. Client responsibilities

The Client will provide accurate business information (such as hours, prices, and services), will review the preview before launch and report any errors, and confirms they have the right to use any logos, photos, or text they provide. The Client is responsible for claims arising from content the Client provides.

12. Limits of responsibility

The Designer will do the work in a professional manner. Apart from that, the website is provided "as is," and the Designer does not guarantee any particular number of visitors, search ranking, or sales. The Designer is not liable for indirect or lost-profit damages, and the Designer's total responsibility under this agreement is limited to the amount the Client paid the Designer in the 12 months before the claim.

13. Ending this agreement

Either side may end this agreement in writing (text or email). If a care plan payment is more than 15 days late, the Designer may pause care plan services after notice. Sections 4, 7, 8, 9, 10, 12, and 14 continue after this agreement ends.

14. General terms

This agreement is governed by the laws of the State of Indiana. The parties will first try to resolve any disagreement by talking in good faith; if that fails, either may bring it in small claims court in the county where the Designer is located. This is the entire agreement between the parties and replaces any earlier discussions; changes must be agreed in writing (text or email counts). If any part is found unenforceable, the rest still applies. The Designer is an independent business, not the Client's employee.

15. Electronic signatures

Both parties agree to sign electronically, and that an electronic signature and typed name have the same effect as a handwritten signature, under the federal E-SIGN Act and Indiana's Uniform Electronic Transactions Act. The Designer's signature below is applied when the Designer sends this agreement.
